TERMS AND CONDITIONS

You acknowledge that participating in events involves, inter alia, the use of high-speed vehicles and associated activities with an inherent danger involved. African Karting Cup Promotions (Pty) Ltd t/a ROK Cup South Africa (hereinafter referred to as "RCSA") nor the members and/or directors of RCSA shall be responsible or may be held liable for any loss, damage, or injury of whatsoever cause, including consequential losses, suffered or caused to any person or property anywhere on or about the RCSA's premises, the Track, or whilst participating in the event, whether such loss, damage, or injury is occasioned by any act or omission of the RCSA or the members and/or directors of the Raceway, or anyone else for whose actions they or any of them would be liable in law, or by reason of force majeure, casus fortuitous, rain or other water, riots, strikes, theft or burglary with or without forcible entry, or by reason of any condition on or off the Track or any building structures, or any defective facilities rented by the RCSA, or caused by any activity carried out by the RCSA, or by other causes of whatsoever nature and however arising.

The undersigned expressly acknowledges and understands that wet tyres will only be available for purchase at Red Star Raceway. As a result, should an event be held at any other venue, wet tyres will not be available for purchase at the track, and it is strongly recommended that all competitors purchase and bring their own set of wet tyres to each race to avoid any inconvenience.

The undersigned shall, at all times, hold the RCSA and its members and/or directors and all persons for whom the RCSA is responsible indemnified against and harmless from, and shall in no manner whatsoever seek or hold any of them liable for, any injury, loss, or damage suffered as a result of personal injury or patrimonial loss arising directly or indirectly from the participation of any person in the activities at the Track and/or at the RCSA event, practice, related activity, or any other activity of the RCSA, or any member and/or director of the RCSA, or any person for whom the RCSA is responsible, whether or not such injury, loss, or damage can be attributed directly or indirectly to wilfulness or negligence of whatsoever nature or degree on the part of the RCSA, any member and/or director of the RCSA, any person for whom the RCSA is responsible, and/or any of the event’s officials, employees, and/or agents.

This indemnification shall include attorney’s fees incurred in defending against any claim or judgment. It is agreed that the undersigned shall have the opportunity to consent to any such settlement, provided, however, that such consent shall not be unreasonably withheld. The undersigned further acknowledges and agrees to have read and to abide by the safety rules of the event and/or RCSA/Motorsport South Africa and agrees not to undertake any action not instructed by the RCSA. The undersigned furthermore agrees that he/she is satisfied with the safety and medical facilities provided and acknowledges that, should he/she be injured and require medical transport via ambulance, RCSA shall not, at any time, be liable for any medical costs incurred. The undersigned further consents and agrees to the regulations of Motorsport South Africa. This indemnification shall extend mutatis mutandis to the undersigned’s spouse, heirs, successors, representatives, agents, and assignees.

Furthermore, the undersigned acknowledges and agrees that any payment made for the rental of a pool engine for the season, or for any individual race event, is strictly non-refundable. In the case of season-long engine rentals, no refund, whether full or partial, shall be issued under any circumstances, including but not limited to withdrawal from the competition, inability to participate in any or all scheduled races, injury, disqualification, or any other reason whatsoever. Similarly, where an engine rental has been secured for a single event, no refund shall be provided once payment has been made, irrespective of whether the undersigned competes in the event or not. It is expressly acknowledged that once payment has been received, the engine shall have been prepared and allocated, and therefore no reimbursement shall be considered under any circumstances.

Additionally, by entering this race, the undersigned expressly acknowledges, notes, and agrees that all racing tyres and wet tyres, whether purchased for race or practice, are strictly non-returnable. No refund, exchange, or credit shall be provided under any circumstances once the tyres have been purchased, regardless of whether they have been used, mounted, or remain unused.

By entering this race, the undersigned further acknowledges and agrees that any photographs, video recordings, or other media captured by the event promoter, RCSA, or its representatives during the event may be used at the promoter’s sole discretion for marketing, promotional, advertising, or other related purposes, without any compensation or prior approval required. The undersigned consents to the use of such media in print, digital, and social media formats and waives any rights to claims or objections regarding the use of their image or likeness in such materials.

The undersigned further acknowledges that he or she has read and understands the Rules and Regulations as stipulated in all official regulations issued by RCSA and Motorsport South Africa and agrees to be bound by the terms herein.
